By accessing and using ChatCFB ("the Service"), you accept and agree to be bound by the terms and provision of this agreement. If you do not agree to abide by the above, please do not use this service.

2. Description of Service

ChatCFB is a college football prediction and social platform that allows users to:

  • Make predictions on college football games
  • Participate in pick 'em leagues with friends and other users
  • Engage in social discussions about college football
  • Access AI-powered insights and analysis
  • View team and player statistics and information

3. User Accounts and Registration

To access certain features of the Service, you must register for an account. You agree to:

  • Provide accurate, current, and complete information during registration
  • Maintain and update your account information
  • Keep your login credentials secure and confidential
  • Accept responsibility for all activities under your account
  • Notify us immediately of any unauthorized use of your account

4. User Conduct and Content

You agree not to use the Service to:

  • Post content that is unlawful, harmful, threatening, abusive, defamatory, or otherwise objectionable
  • Harass, intimidate, or harm other users
  • Impersonate any person or entity or misrepresent your affiliation

You retain ownership of content you post, but grant us a worldwide, non-exclusive, royalty-free license to use, modify, and display such content in connection with the Service.

Important: This Service is not intended for gambling or betting purposes. Users should not rely on predictions or analysis for any form of wagering or financial decisions.

8. Limitation of Liability

In no event shall ChatCFB, its directors, employees, or agents be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or other intangible losses, resulting from your use of the Service.

9. Termination

We may terminate or suspend your account and access to the Service immediately, without prior notice, for any reason, including if you breach these Terms of Service.

10. Changes to Terms

We reserve the right to modify these terms at any time. We will notify users of significant changes via email or through the Service. Continued use of the Service after changes constitutes acceptance of the new terms.

These Terms of Service are governed by and construed in accordance with the laws of the United States, without regard to conflict of law principles.

13. DMCA & Copyright Notices

ChatCFB respects the intellectual property rights of others. If you believe that any content on our platform infringes your copyright, you may submit a notice under the Digital Millennium Copyright Act (DMCA) that includes:

  • A description of the copyrighted work you claim has been infringed
  • A description of where the allegedly infringing material is located on our Service
  • Your contact information (name, address, phone number, email)
  • A statement that you have a good faith belief the use is not authorized by the copyright owner
  • A statement, under penalty of perjury, that the information in your notice is accurate and that you are the copyright owner or authorized to act on their behalf
  • Your physical or electronic signature

Submit DMCA notices through the feedback feature within the app. We will respond to valid notices in accordance with applicable law and may remove or disable access to the allegedly infringing content.

14. Dispute Resolution & Arbitration

Binding Arbitration: Any dispute, claim, or controversy arising out of or relating to these Terms or your use of the Service shall be resolved exclusively through final and binding individual arbitration, rather than in court. The arbitration shall be administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules.

Class Action Waiver: You and ChatCFB agree that each may bring claims against the other only in your or its individual capacity, and not as a plaintiff or class member in any purported class, consolidated, or representative action. Unless both you and ChatCFB agree otherwise, the arbitrator may not consolidate or join more than one person's claims.

Exceptions: Either party may bring an individual action in small claims court for disputes within its jurisdiction. Nothing in this section prevents either party from seeking injunctive or other equitable relief in court for intellectual property infringement or misuse.

Opt-Out: You may opt out of this arbitration provision by sending written notice within 30 days of first accepting these Terms, via the feedback feature in the app.

15. Email Communications

By creating an account on ChatCFB, you consent to receive transactional emails related to your account activity, including league invitations, pick reminders, weekly recaps, and platform announcements. These communications are sent by "Bo" on behalf of ChatCFB.

You may manage your email preferences through your Profile settings or by using the unsubscribe mechanism provided in each email. Note that you cannot opt out of essential account-related communications (e.g., security alerts, Terms updates) while maintaining an active account.

Note: These terms are effective as of the date listed above and apply to all users of the ChatCFB service. By continuing to use our service, you acknowledge that you have read, understood, and agree to be bound by these terms.
